Welcome to Sunset Fine Art Services Terms and Conditions agreement. For purposes of this agreement, “Sunset FAS” refers to Sunset Fine Art Services LLC, and “Client” refers to the receiver of services provided for and outlined above. Client understands and agrees to outlined services provided by Sunset FAS and are subject to the following terms and conditions.

 

1. Client Obligation: Sunset FAS is not responsible for verbally reading terms and conditions and it is understood that the client is responsible for reading and understanding the terms of this agreement prior to signing.

2. Agreement: Sunset FAS shall only be responsible for completing a service request that is clearly indicated on Bill Of Lading. Any requests verbally submitted outside of this document will not be fulfilled by Sunset FAS without consideration by Sunset FAS and correction of Bill of Lading.

3. Insurance:  The client is responsible for insuring their artwork during transportation and installation. Sunset FAS can assist in the arranging of insurance coverage if requested, but remains the clients responsibility to ensure adequate coverage.

4. Packing Liability: Sunset FAS are exempt from responsibility of efficiency of safety for client property if Sunset FAS did not initially pack and secure property prior to Sunset FAS possession of client property. It is the responsibility of the shipper to ensure that all property is packed securely and labeled appropriately. Sunset FAS will not be responsible for unwrapping, unpacking, or opening any crate or box upon delivery unless otherwise requested in advance by the client, whose name is on the existing bill of lading. The client is responsible for notifying Sunset FAS in advance for any specific packing requirements or requests.

5. Transportation Liability: Sunset FAS will not be held liable for the damage or loss of client property due to negligence of vehicle operators outside of Sunset FAS, acts of God, inclement weather, impassable routes, theft, breakdown or mechanical failure of vehicle or equipment.

6. Estimates, Invoices and Rates: Sunset FAS estimates will be provided upon request of services but is not a guaranteed cost for the service in actuality. Sunset FAS reserves the authority to amend any and all estimates issued upon any and all change of service agreed upon prior to final invoice delivery. This amendment may occur due to additional items being added to delivery, installation, or packing service, as well as, any additional waiting time or time added to service due to difficult access to the delivery location.

7. Validity From Client: Client required to provide accurate information regarding client property being transported, packed, installed, or removed. As well as, proper and appropriate information associated with Sunset FAS pick up and delivery. Sunset FAS will not be responsible for any or all damage or loss of client property as a result of misinformation provided by the customer. Client responsible for compensating any additional costs.

8. Confidentiality: Sunset FAS vows to protect all sensitive information about the client as well as any information shared between the parties during the course of the agreement/relationship.

9. Client Absence: Sunset FAS will not be held responsible for any and all damage, or loss of client property, when client requests expressively to pick up or drop off at a location where the client is not present at the time of pickup or delivery.

10. Change or Cancellation: The client must provide 48 hours’ notice for any changes or cancellations to scheduled services. Failure to provide this timely notice may result in additional fees or charges based on prior agreement. Sunset FAS holds the right to terminate any agreement it deems necessary.

11. Subcontracting:  Sunset FAS reserves the right to subcontract certain services to third parties without prior consultation with the  client when deemed necessary. However, upon request, Sunset FAS will provide detailed arrangements.

12. Delay: Sunset FAS will not be responsible or liable for any additional costs accrued due to late deliveries or missed connections with the  client. Additionally, Sunset FAS are not bound to the transport of client property unless otherwise agreed upon in writing on Bill Of Lading. 

13. Late Fees: An additional three percent (3%) of total amount owed to Sunset FAS will be applied immediately to invoice 30 days after invoice due date and two percent (2%) every month the invoice goes unpaid.
